By purchasing, downloading, or using AXIOM-EMU (“the Software”), you (“Licensee”) agree to these Terms of Service. If you do not agree, do not purchase or use the Software. AXIOM-EMU is operated by the project maintainers (“we”, “us”).
On payment, we grant you a non-exclusive, perpetual license to install, configure, and operate the Software on infrastructure you control, for the player capacity tier you purchased. The license is bound to your account and the hardware identifier(s) registered with it.
Free trial licenses are time-limited and revert to inactive at expiry. Commercial use during a trial is permitted; the trial converts to read-only on expiry until upgraded to a paid license.

The Software is a digital product delivered immediately on payment. All sales are final and non-refundable, including (but not limited to) cases where you change your mind, your hosting setup is incompatible, you are dissatisfied with included features, or you cease to operate your server. Try the free trial before purchasing.
Setup and installation services are the one exception. These are labour, not a download, so if we are unable to carry out the work we will refund the service fee in full. That refund covers the service fee only - any license fee purchased alongside it remains non-refundable under the paragraph above, since the Software itself was delivered. A service is considered delivered once the server is running and handed over as described in §6a, and is non-refundable from that point. If you become unreachable, or do not provide the access the work requires within a reasonable period after purchase, we may treat the service as delivered.
A purchased setup service covers getting your server installed and operational, and nothing beyond that. Specifically, it covers deploying the server binaries, creating and initialising the database, activating and verifying your license key, forwarding the required ports and setting firewall rules, bringing all server processes up, and confirming that a game client can connect and log in.
It does not include configuration of game content or server identity. That means experience, drop and reward rates; item, shop and monster data; event schedules; custom content; and any website, CMS or launcher branding. Those are configured through XML, are documented in full, and remain your responsibility.
The service is a one-time piece of work and does not include ongoing administration, game mastering, monitoring, hosting, backups, or reinstallation after you change hardware or hosting provider. Requests beyond the scope above are not covered by the service fee and do not constitute a failure to deliver under §6.
Initiating a chargeback, payment dispute, or PayPal claim against a completed purchase will result in immediate and permanent termination of all licenses held by the disputing account, without recovery. The dispute does not invalidate §6.
If you believe a charge was made in error, contact us first - we respond to support requests faster than payment processors handle disputes.
Updates within a major version (e.g. V1.x) are delivered through the auto-updater and customer downloads section, included for the lifetime of the major version. We do not deprecate or paywall updates retroactively.
Each license includes one free upgrade to the immediately following major version. Subsequent major versions are offered at a reduced upgrade price to existing licensees. Major version upgrades may introduce breaking changes documented in the changelog.
Support covers installation, configuration, and bug reports for the Software as shipped. Custom development, third-party plugin debugging, and host-environment troubleshooting beyond standard requirements are outside the scope of included support.
The Software is provided “as is”. We are not liable for indirect, incidental, or consequential damages including loss of players, revenue, data, or reputation arising from use of the Software. Our maximum liability under any claim is limited to the amount you paid for the license in the twelve months preceding the claim.
We may terminate a license for material breach of these Terms, including the conduct described in §4 and §7. On termination, you must cease all use of the Software and destroy any copies in your possession. No refund is owed.

We may update these Terms. Material changes will be announced in Discord and at the top of this page. Continued use of the Software after a change constitutes acceptance.
